Federal Employers Liability Act (FELA)
Cotten Schmidt & Abbott has defended claims brought against railroad companies under the Federal Employers Liability Act (FELA) for years. The incidents giving rise to those claims have occurred from as far north as Chicago, Illinois, and southward to New Orleans, Louisiana. The resulting cases have been tried between those two (2) distant points.
As part of our work in the Federal Employers Liability Act (FELA) practice area, the Firm has been called out on an emergency basis to investigate incidents within minutes of their occurrences.
In the course of handling so many of these cases, Cotten Schmidt & Abbott had developed an expertise in the operation modes of railroads, particularly what their employees are expected to do or avoid and how they are to function properly in their defined job responsibilities. That expertise has developed, in part, from actually “riding the rails” to learn firsthand what railroad employees experience in real time situations.
